Official Contest Rules
HOW TO ENTER
NO PURCHASE NECESSARY. Beginning at 12:00 am Eastern Time (“ET”) on October 18, 2010 entrants can enter the How Far Would You Go To Make Your Family Smile (the “Contest”) by telling itravel2000 the 3 things they would do in Orlando, Florida that would make their family smile in an online ballot at www.itravel2000.com/smile.aspx. Any use of automated devices is prohibited. The Sponsors of this Contest are itravel2000, Orlando/Orange County Convention &Visitors Bureau Inc. and Petro-Canada collectively (the “Sponsors”).
Entries must be received no later than 11:59 pm ET on November 18th, 2010 (the “Contest Closing Date”).
There are one hundred and eleven individual prizes available to be won:
The Grand Prize package consists of:
- One Million (1,000,000) Petro-Canada PETRO-POINTS to be redeemed for a driving vacation to Orlando, Florida.
The Second Place package consists of:
- One of one hundred $25 Petro-Canada gift cards
The Third Place package consists of:
- One of ten $100 itravel2000 gift cards
Sponsors will make a random draw from eligible entries on November 19th, 2010 (see details below).
ALL GRAND PRIZE INCLUSIONS ARE PER ITRAVEL2000, Orlando/Orange County Convention & Visitors Bureau Inc and Petro-Canada.
NO PURCHASE NECESSARY. Although online access and an e-mail account are required in order to participate in the Contest, no purchase is required: many public libraries, Internet cafés, retail businesses and others offer access to the Internet and a number of Internet service providers and other companies offer free e-mail accounts.
Prize(s):
The prizes consists of: One Million (one million) Petro-Canada PETRO-POINTS to be used towards a driving vacation to Orlando, Florida, one of one hundred $25 Petro-Canada gift cards and one of ten $100 itravel2000 gift cards.
Retail value of the grand prize is $1,000 CAD. Limit one (1) Prize per person. The prize as described may not be exchanged for cash, is non-transferable, non-refundable, non-salable, and must be accepted as awarded, without substitutions. itravel2000 reserves the right to substitute the awarded prize at any time.
Retail value of the second prize is $25 CAD. Limit one (1) Prize per person. The prize as described may not be exchanged for cash, is non-transferable, non-refundable, non-salable, and must be accepted as awarded, without substitutions. itravel2000 reserves the right to substitute the awarded prize at any time.
Retail value of the third prize is $100 CAD. Limit one (1) Prize per person. The prize as described may not be exchanged for cash, is non-transferable, non-refundable, non-salable, and must be accepted as awarded, without substitutions. itravel2000 reserves the right to substitute the awarded prize at any time.
At their election, and in the event the prize, or any portion thereof, cannot be awarded as described in these Official Rules, the Sponsors reserve the right to substitute a prize of equivalent or greater retail value should the prize become unavailable due to any reason. itravel2000 reserves the right to substitute the awarded prize at any time. Prize must be taken as specified by the Sponsors in their sole discretion or the prize will be forfeit.
Winner and guest(s) are responsible for ensuring that all travel papers (visas, passports, tourist cards, etc.) or proper identification for country of travel are in good order, and are valid prior to, and for the entire duration of, the prize trip. All required documentation for the prize will be sent via email directly to the selected entrant only after the selected entrant has met the eligibility requirements outlined in these Contest Rules and Regulations and the Official Contest Declaration and Release Form has been signed by the selected entrant and his/her guests, and returned to and received by itravel2000. Winner’s guest must have reached the age of majority in his/her province of residence by the contest draw date to be able to participate in the prize trip. No changes to travel dates or passenger names are permitted once the booking has been made.
THE DRAW
A representative of itravel2000 will select one (1) winner from all eligible entries received, based on random draw. The selection will be made at approximately 11:00 am on November 19th, 2010 at 2350 Matheson Blvd. East, Mississauga, Ontario. Selected entrants will be contacted by telephone, as set out on their entry.
If a selected entrant cannot be reached within three (3) days of the selection, incorrectly answers the skill-testing question, declines the prize, or fails to return a release of liability as specified, another eligible entrant will be selected until the prize is awarded.
The chances of being selected in the Contest draw depend upon the total number of eligible entries received. All decisions of the judges are final in all matters relating to this Contest.
ELIGIBILITY
The Contest is open to all residents of Canada, excluding Quebec, who have reached the age of majority in the province in which they reside by contest draw date excluding: employees of the Sponsors and their respective affiliates, subsidiaries, franchisees, advertising and promotional agencies, and any other parties engaged in the development, production or distribution of the Contest materials, or those living in the same household as any of the above.
GENERAL CONDITIONS
All Contest entries become the property of itravel2000 and no correspondence will be entered into except with selected entrant(s), and those who request a complete set of Contest Rules and Regulations by mailing their request to: itravel2000, 2350 Matheson Blvd., Mississauga, Ontario L4W 5G9 and including a self-addressed postage-stamped envelope. By entering the Contest, the selected entrant consents to the use of his/her name, city of residence and image on videotape and/or photograph in any publicity carried out by any one or all of the Sponsors with respect to this Contest, without further notice or compensation.
By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules and Regulations, including eligibility requirements.
By entering this Contest electronically and voluntarily providing your personal information, entrants consent and agree to the Sponsor’s collection and use of the entrant’s information for the administration of this Contest and agree to Sponsor’s use of entrant information for the purpose of contacting entrant in relation to this Contest. Entrant’s information may be revoked at any time (without revoking entrant’s participation in the Contest or impairing entrant’s chances of winning) by submitting entrant’s email address to “unsubscribe” or by writing to the Sponsors at the address above.
Entrants release and hold harmless the Sponsors, their parent and related companies, their affiliates, subsidiaries, advertising, promotional agencies and directors, officers, agents, employees and all others associated with the development and execution of the Contest, from and against any and all liability with respect to or in any way arising from the Contest and the awarding, use, or misuse of any prize awarded, including liability for personal injury or damage to property.
The Sponsors are not responsible for incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user’s system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations.
No responsibility will be taken by itravel2000 for any failure of the website during the Contest or for any problems or technical malfunction or other failures of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by itravel2000 on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, itravel2000 reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. In the event of a dispute regarding who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account.
The Contest is subject to all applicable Federal, Provincial and Municipal laws.
The Sponsors reserve the right, in their sole discretion, to terminate, modify in any way or suspend this Contest for any reason prior to the Contest Closing Date without notice.
- HOW TO WIN AND CLAIM A PRIZE. Each potential winner will be notified by phone, mail or email. To be declared a winner, the potential winner drawn must have correctly answered the required mathematical skill-testing question to be administered by phone at a mutually convenient time and must sign a form of Declaration of Compliance and Release (and if necessary parental consent) (see Rule No. 8 below), and otherwise comply with the official contest rules. Each potential winner (or parent or legal guardian as applicable), may be required to furnish proof of identification that may include a driver’s license or other form of picture identification as part of the verification process. If a potential winner cannot be located or does not respond within 14 days of notification, the potential winner will be disqualified and forfeits the prize and the Contest Sponsors may, at their sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsors or its representatives will attempt to contact, and who will be subject to disqualification, in the same manner. The Contest Sponsors will not be responsible for failed attempts to notify any potential winner.
Awarding of the prize is subject to verification and compliance with the official contest rules. Allow four (4) to six (6) weeks for verification. No responsibility is assumed by the Contest Sponsors for any postal mail or overnight delivery returned as undeliverable without a forwarding address. No responsibility is assumed by Contest Sponsors for prizes after they have been shipped. Contest Sponsors make no representations or warranties of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damages to prizes after delivery. Unclaimed prizes will not be awarded.
- ADDITIONAL CONDITIONS OF PARTICIPATION. By participating in this Contest, each entrant accepts and agrees to these official contest rules and all decisions of the contest judges (who may be employees, agents or independent contractors of the Contest Sponsor), which shall be final and legally binding on the entrant in all matters relating to this Contest including, without limitation, eligibility and/or disqualification of entries. All entries become the property of the Contest Sponsors and will not be returned. In order to be confirmed a winner and receive a prize, each potential winner (or each potential winner’s parent or legal guardian if the potential winner is a minor) will be required to sign the Contest Sponsor’s form of Declaration of Compliance and Release which confirms compliance with these official contest rules and releases the Contest Sponsors and their affiliated companies, agencies, contest prize suppliers and their respective officers, directors, employees and agents (collectively, the “Contest Group”) from all liability with respect to the entrant’s participation in this Contest and the awarding and use of the prize. Each potential winner agrees to the use of his/her name, comments, photograph, and other likeness for publicity purposes, and grants to the Contest Sponsors any and all rights to said use without further compensation. Entrants who have not complied with the official contest rules will be disqualified.
- Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.
- Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.
- Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
ELIGIBILITY. Contest is open to residents of Canada, excluding Quebec, 18 years of age or older, except employees, representatives and agents of the Contest Sponsors, itravel2000, any of its affiliates and if applicable, their respective advertising or promotion agencies, contest judges, contest prize suppliers, any other companies engaged in the development, production, or distribution of materials for this Contest, and members of the immediate families of, or persons domiciled with, any of the above.
Entrants between the ages of 18 and the age of majority in their province of residence will require the permission of their parent or legal guardian to enter the Contest and the parent or legal guardian of such a minor will also be required to sign and deliver the Contest Sponsor’s form of Declaration and Release. In the event it is discovered that parental consent was not obtained, the entry will be void. Prizes won by minors will be awarded to the minor’s parent or legal guardian.
- LIMITATION OF LIABILITY. By entering this Contest, each winner acknowledges and agrees that the Contest Group: i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding or use of the prize, (ii) make no warranty, guaranty or representation of any kind concerning the prize, (iii) disclaim any implied warranty, and (iv) are not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance or use of the prize or otherwise from such entrant’s participation in this Contest.
- The Contest Sponsors and its affiliates may, at their sole discretion and without liability, terminate the Contest in whole or in part, without notice, or to modify or suspend the Contest at any time if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Contest Sponsors corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these official contest rules. Without restricting the generality of the foregoing, if for any reason more entrants receive a “win” notice than the number of prizes stated herein, the Contest Sponsor reserves the right, in its sole discretion, to terminate the Contest in whole or in part, or amend or suspend it and award only the number of prizes stated in these official contest rules via a random drawing for the prizes not yet distributed at the time the Contest is terminated, suspended or amended. In the event of early termination of the Contest, a notice will be posted online and a random drawing to award the prize(s) will be conducted from among all eligible entries received prior to the time of termination. In no event will the number of prizes awarded exceed the available number of prizes as specified in these official contest rules.
- The Contest Group is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to, errors in advertising, the official rules, the announcement of winners, distribution of the prizes or technical malfunctions of telephone network lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any email to be received by the Contest Sponsors or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof. The Contest Group is not responsible for damage to a user’s system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.
- The Contest Group does not warrant that access to or use of the Contest will be uninterrupted or error-free.
- Under no circumstances, including negligence, shall the Contest Group be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the service, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability.
- This Contest is subject to all applicable federal, provincial and municipal laws.
- All issues and questions concerning the construction, validity, interpretation and enforceability of these official Contest rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
- In the event of any discrepancies between the English language rules and the French language rules for this Contest, the English rules shall prevail.
- PERSONAL INFORMATION. Unless entrants otherwise indicate, the personal information gathered about entrants in the course of this Contest will be used solely by the Contest Sponsors for the administration of the Contest and in connection with any publicity relating to the Contest.
