Terms and Conditions

NO PURCHASE NECESSARY


These terms and conditions, in addition to the itravel2000 Terms and Conditions, govern the Let it Snow Promotion ("LISP"). Any capitalized terms not defined herein shall have the meanings ascribed to them in the itravel2000 Terms and Conditions within your booking invoice. The following terms and conditions shall govern in the event of any conflict with any provisions of the itravel2000 Terms and Conditions. As used below:

"Customer"
means a Canadian resident that has purchased a Qualifying Product from itravel2000.

"Customer Information Postal Code"
means a valid Canadian postal code as defined under “Client Information” section of this invoice. The Customer Information Postal Code is the ONLY information used to establish the Weather Station to which the booking will be linked.

"Lead Passenger"
means the Customer’s name and related information that is provided in the “Client Information” section of the invoice. This information will be used to determine Customer Information Postal Code and the related Weather Station, as well as the name of the individual to which any rebate payment will be made and the address to which payment will be mailed. In the event there are multiple passengers or individuals listed in a booking or who will be providing payment with respect to a booking, and separate postal codes are desired for each passenger to obtain a different Weather Station or separate payout to individuals other than the Lead Passenger, the booking MUST be split into separate invoices and the desired Lead Passenger information must be detailed in the new invoice’s “Client Information” section. In the event of any discrepancy or dispute, the original invoice and Lead Passenger detailed in the “Client Information” section of that invoice will be used.

"Qualifying Product"
means a product from itravel2000 that is one of the products listed below by a supplier that the Customer has purchased during the offer period for travel during the departure dates specified by the supplier as follows:

  1. A pre-package vacation and cruise product including group bookings from Sunquest Vacations (this does not include any related companies of Sunquest or Thomas Cook Canada Inc.) purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  2. A pre-package vacation , and cruise product including group bookings from Sunwing Vacations purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  3. A pre-package vacation product including group bookings from Signature Vacations purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  4. A pre-package vacation product excluding group bookings from WestJ et Vacations purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  5. A pre-package vacation and cruise product excluding group bookings from Transat Holidays purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  6. A pre-package vacation vacations and cruise product excluding group bookings from Nolitours purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  7. A pre-package cruise or cruise only product booked by phone with Encore Cruise Escapes purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012, or
  8. A pre-package vacation excluding group bookings from Air Canada Vacations purchased between August 15, 2011 and October 3, 2011 with a Departure Date between November 1, 2011 and April 30, 2012.

“UTC” means coordinated universal time.

"Weather Station"
means the corresponding Customer Information Postal Code to the weather station/airport listed below:

  1. Ontario postal codes are to Toronto Pearson International Airport,
  2. British Columbia, Alberta, Saskatchewan, Manitoba, Yukon Territory, Northwest Territories, and Nunavut postal codes are to Calgary International Airport,
  3. Quebec postal codes are to Montreal/Pierre Elliot Trudeau Airport,
  4. New Brunswick, Newfoundland and Labrador, Nova Scotia, and Prince Edward Island postal codes are to Halifax International Airport.

"Weather Condition" means the occurrence of a Weather Event that would entitle a Customer under the LISP to a rebate payment.

"Weather Event" means greater than 5.0 inches of snowfall during the UTC period beginning on January 1, 2012, as measured at the applicable Weather Station as follows:

  1. Toronto Pearson International Airport: 6am to 6am UTC
  2. Calgary International Airport: 8am to 8am UTC
  3. Pierre Elliot Trudeau Airport: 6am to 6am UTC
  4. Halifax International Airport: 5am to 5am UTC

Program Details:
How it Works: The LISP from itravel2000 allows you to recover some of your travel costs (taxes and fees excluded) if you have purchased a Qualifying Product and the applicable Weather Station experiences the specified Weather Condition on January 1, 2012. By way of example, if your Customer Information Postal Code is located in Ontario, you will be eligible to receive a rebate cheque if there is greater than 5.0 inches of snowfall during the 6am-to-6am UTC period beginning on January 1, 2012, as measured at the Toronto Pearson International Airport.

Invoice Payment Terms:All products purchased and described in this invoice shall be paid when due or up to 4 days prior to October 31, 2011 whichever is sooner. Final payment will automatically be applied when due as described in you invoice or on October 31, 2011 whichever is sooner. Any additions or changes to products purchased that may occur during the Qualifying Product’s specified purchase dates, shall be paid in full at time of booking. If full payment is not received by itravel2000.com when due you will no longer be entitled to participate in the LISP program. All payments are final and non-refundable.

Payment and Rebate Terms: LISP has no cash value and is non-transferable. The determination of whether a Weather Condition has been met is within the sole discretion of itravel2000. You agree that LISP does not constitute insurance, and your right to receive a rebate is not dependent upon or linked to any actual loss that you may suffer. If itravel2000 determines that a Weather Condition has been met, a notice will be sent to your e-mail address on invoice by January 10, 2012. The rebate payment shall be made by cheque payable to the Lead Passenger of this invoice and mailed to the address as detailed in the Client Information section on January 24, 2012, or on the Friday following your Departure Date, whichever is later. If you do not receive your rebate cheque, or have any other problem related to LISP, please send an e-mail to letitsnow@itravel2000.com with your contact information, Let It Snow Confirmation number, and a complete description of the problem. In order to be entitled to a rebate cheque, entrants must first correctly answer, unaided, a time limited, mathematical skill testing question.

Eligibility:
LISP is conducted by itravel2000, and is open to all residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry. Void where prohibited. All employees or agents of the itravel2000 and its parents, affiliates, subsidiaries and agents, and any entity involved in the production, implementation, promotion, administration or fulfillment of LISP, and the individuals living in the same households of each of the above are ineligible to participate in LISP.

Miscellaneous:
Whether a Weather Condition has occurred at the Weather Station is determined solely by data provided by a third party data provider ("Weather Data"), and you agree that the Weather Data shall be the exclusive factor in determining your right to payment under LISP, irrespective of the accuracy of the Weather Data. itravel2000 reserves the right in its sole discretion to cancel or modify LISP at any time (subject to the approve of the Régie des alcools des courses et des jeux (the ”Régie”) in Quebec) without notice. You agree to send any inquiries related to your LISP to letitsnow@itravel2000.com.

No Purchase Necessary:
Available to Canadian residents only, obtain a FREE qualification ballot worth $500 toward future travel booked through itravel2000 of a Qualifying Product as defined herein, limited to one per household, by going to www.itravel2000.com/nopurchasenecessary.aspx  and following the instructions detailed there or for a copy of the official rules sent to you, by writing to: itravel2000 Let It Snow Contest, 2350 Matheson Blvd East, Mississauga, ON, L4W 5G9.
Contestants will be required to return a signed release and acknowledgement form before being declared a winner confirming compliance with these Terms and Conditions and releasing iTravel2000 from any liability in respect of LISP including but not limited to the prizes awarded.
By entering this contest each contestant:

  1. provides his or her consent to the use of his/her entry name, address and/or photograph, likeness, voice or statements in any publicity carried out by iTravel2000 and/or its advertising agencies, without further compensation, permission, or notification;
  2. agrees to sign a publicity release granting and acknowledging the rights of itravel2000, in its or its agents’ discretion, to publish or broadcast the selected contestant’s picture, portrait, likeness, name, address, voice and statements for publicity purposes, without any further compensation other than the value of the prize offered, and for itravel2000 to obtain and deliver his or her name, address, and other information to third parties for the purpose of administering LISP and for such other uses by itravel2000 as permitted by applicable law;
  3. acknowledges and agrees that, by entering the LISP, the contestant releases itravel2000, the administrators of the LISP and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any liability for loss, harm, damages, costs or expenses, arising out of or in any way connected with participation in the LISP, participation in any rebate-related activity, the awarding of a rebate, the use of personal information as aforementioned, or the acceptance, use or misuse of a rebate, including, without limitation, loss, harm, damages, costs or expenses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and the entrant will sign declaration and release forms, or such other supporting documentation that itravel2000 may request, to give effect to such release upon request by itravel2000.

Odds of Winning: Chances of receiving a benefit from LISP depend on the amount of snow that falls within the relevant time period at the relevant Weather Station as defined in these rules. There is no limit to the number of qualifying entries.

Flawed Entry:
Itravel2000 reserves the right in its sole discretion to disqualify any LISP contest entry. itravel2000.com is not responsible or liable for:

  1. any incorrect or inaccurate information, whether caused by Internet users or by any of the equipment or programming associated with or used in connection with LISP or by any technical or human error which may occur in the processing of LISP contest entries;
  2. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line or system failure, theft or destruction or unauthorized access to, alteration of, LISP contest entries;
  3. any technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, or problems of entrants on account of technical problems; or any other technical problem which delays, mutilates or in any other respect results in a LISP contest entry not conforming to the contest rules. Decisions of itravel2000.com or judges are final in this regard.

These terms and conditions are subject to amendment by itravel2000.com. itravel2000.com may, with the consent of the Régie, withdraw, terminate or modify all or any part of LISP at any time in the event of production, technical failure or corruption, tampering, unauthorized intervention, fraud or other unanticipated problems or irregularities, or mistakes of any nature whatsoever not directly caused by itravel2000.com which, in the opinion of itravel2000.com, affect the administration, security, fairness, integrity or proper conduct of LISP, or the odds of winning. All decisions regarding this contest and the selection of winners are in the sole discretion of itravel2000 and are final.

Quebec Residents:
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
The terms of this contest, as set out in these Rules, are not subject to amendment or counter-offer, except as set out herein.
The following terms may be included in the confirmation e-mail:
itravel2000.com provides all customer service with respect to the Let it Snow Promotion. If you have any question, comment, or issue with the Let it Snow Promotion, please send an e-mail with your name, e-mail address, telephone number, and [LISP confirmation number] to letitsnow@itravel2000.com.

Petro Points Promotion:
You can participate in the LISP if you use Petro Points to purchase the Qualifying Product. If Petro Points are used as the only form of payment and if itravel2000 determines that a Weather Condition has been met the rebate payment shall be made by Petro Points. If Petro Points are used as partial form of payment and itravel2000 determines that a Weather Condition has been met the rebate payment shall be made on a pro rata basis by Petro Points with any balance paid by cheque in keeping with the method of payment.

Governing Law:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and itravel2000 in connection with the LISP, shall be governed by and construed in accordance with the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
